The I MaxxPro ^® Guarantee

If MasterLine^® I MaxxPro^® Insecticide fails to stop termites at any time within five years of initial treatment, we will gladly reimburse you, the direct purchaser of the product (“Buyer”), for MasterLine^® I MaxxPro^® purchase costs and labor costs necessary for a retreatment according to the guidelines set forth below and provided that all terms and conditions of this Guarantee have been met.

MasterLine^® I MaxxPro^® Guarantee Qualifications

• This Guarantee is valid only for structures receiving an initial full treatment* of MasterLine^® I MaxxPro^® and is not valid with partial treatments.
• MasterLine^® I MaxxPro^® must be used and applied at full treatment rates as set forth in the label. Buyer must read and follow label directions. Failure to follow directions and apply at label rates may lead to disqualification of the guarantee for all of Buyer’s registered structures, at the sole discretion of Univar.
• The MasterLine^® I MaxxPro^® Guarantee is valid only for qualified initial treatments to structures beginning 1/1/06.
• Buyer must register the structure on www.MasterLine.com within 45 days of initial treatment. Buyer’s registration must contain the following accurate information; treatment site address, property type, treatment date, linear feet, treatment rate, gallons of dilution applied, and treatment type.
• Buyer must inspect the treatment site on an annual basis.
• Prior to applying MasterLine^® I MaxxPro^®, Buyer must inspect the entire structure and prepare a sketch indicating evidence, if any, of termites and condition of the termite damage. The sketch document should include the application date, the rate of MasterLine^® I MaxxPro^® used and how I MaxxPro^® was applied.
• MasterLine^® I MaxxPro^® must be used for all retreatments. Retreatments must be completed within 90 days of detecting reinfestation.

Settlement Claims – Limit One Claim per Registered Structure

MasterLine^® I MaxxPro^® Guarantee settlement claims will be made within these limits:

• Buyer must submit claims within 90 days of retreatment.
• All claims shall be submitted at www.PestWeb.com.
• Univar will reimburse all valid claims for up to 100% of Buyer’s MasterLine^® I MaxxPro^® retreatment cost and Buyer’s labor cost for the retreatment, up to a maximum of $1,000 for registered residential structures.
• Univar will reimburse all valid claims for commercial retreatment at 100% of MasterLine^® I MaxxPro^® cost of retreatment and Buyer’s labor cost for the retreatment, up to a maximum of $5,000 for registered commercial structures.
• Where Buyer submits a claim to its insurance company for structural damage to a registered structure and its insurance company pays such claim, Univar will reimburseup to 50% of Buyer’s insurance deductible up to a maximum of $500 per structure.
• Other than the insurance deductible reimbursement described above, structural damage is not covered by the MasterLine^® I MaxxPro^® Guarantee.
• Claims may include; reimbursement of costs of retreatment product, labor costs for retreatment and payment of insurance deductible as described above on a single registered structure.

Additional Terms

These Terms and conditions may be amended or modified by Univar at anytime without notice.

Univar reserves the right to review all treatment records, Buyer shall maintain all records for a period of 5 years from the date of claim.

• Claims may be paid with check or with MasterLine^® I MaxxPro^®, if available, and selected by Buyer.
• Univar reserves the right to modify or terminate this Guarantee at any time without notice.

This guarantee represents Buyer’s sole remedy in the event MasterLine^® I MaxxPro^® fails to stop termites within five years of treatment. Univar is not liable for any other damages except those described in this Guarantee. UNIVAR IS NOT LIABLE FOR ANY CONSEQUENTIAL INCIDENTIAL OR PUNITIVE DAMAGES.

This guarantee is only applicable to the Buyer and is not assignable to any other party, including but not limited to, purchasers of the MasterLine^® I MaxxPro^® or any users of MasterLine^® I MaxxPro^® other than Buyer.

* Full treatment: Each MasterLine^® I MaxxPro^® product label describes a full treatment of I MaxxPro ^® Termiticide/Insecticide along with the proper dilution rates to be used in order to qualify for the MasterLine^® I MaxxPro^® Guarantee.
